The Committee members unanimously upheld the said resolution.
The Bill (Reg. No. 1315) defines a new status of the State Border Service and the State Service for Special Communication and Information Protection of Ukraine, converting them from the status of bodies of executive power to the status of public authority bodies, subordinate to the President of Ukraine.
Having studied the report of the Scientific Experts Office of The Verkhovna Rada of Ukraine, the People´s Deputies stated that the Bill fails to comply with the Constitution of Ukraine that does not envisage functioning of the public authority bodies. The Basic Law envisages only three branches of power, namely, executive, legislative and judicial.
As a result of the discussion, the Committee will forward their remarks to the Committee on Economic Policy the profile committee on elaboration and prior consideration of the Bill.
